Jabir Case - Justice On Trial


[The assets value of {1}. Ramla Electro-Mechanical Establishment, {2}. Summer Pool Trading Est., and {3}. Premier General Contracting Est. in Abu Dhabi, UAE., Group of concerns, the value estimated including work contracts, human resources and procurement in projects of worth US Dollar $10 crore].

[A PART OF MEMORANDUM OF WRIT PETITION FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA.

1. The petitioner is an Indian citizen went to UAE on 1.6.1979. The petitioner has been doing business for a period of about 18 years in Abu Dabi the capital of United Arab Emirates. In the year 1983 the petitioner obtained trade license in the name and style “Ramla Electro-Mechanical Establishment” and was engaged in the activities of electrical contracting, installations and maintenance of central AC, elevators, fire and safety, demolishing etc.

A true copy of the trade license issued to the petitioner is produced herewith and marked as Exhibit P1. Similarly, copies of some of the orders, contracts, etc., issued to the petitioner including the prime properties of the ruling families in the country is produced herewith and marked as Exhibit P2. A true English translation of Exhibit P2 is produced herewith and marked as Exhibit P2 (a).

2. In the year 1987 the petitioner started a Building material trading and was issued with a license in the name and style “ Summer Pool Building Materials Trading Establishment” under the sponsorship of Isahammad Hassan Jafar.

3. Apart from the same on 15.5.1990 the petitioner entered into general contracting with another license under the same sponsorship of Ishahammad Hassan Jafar in the name and style “Premier General Contracting and Maintenance Establishment”.

It was registered in onshore and offshore, oil and gas sectors, PWD, other Government and semi Government Companies in UAE. A copy of trade license, oil and gas registration certificate, contracts are produced herewith and marked as Exhibit P3. A true English translation of Exhibit P3 is produced herewith and marked as Exhibit P3 (a).

The petitioner was flying high in the field of business and was having a very good reputation across UAE.

The 1st establishment was having an office cum warehouse block with an open yard and compound wall and the area was 3000 sq. meters. The same was close to a prime property of a ruling family Shaikh Saif Bin Mohammad Ali Nahyan.

The value of the 1st establishment of the petitioner was worth 15 million UAE Dirham. (15 crores INR and the earning from the same per annum crossed more than 2.5 million UAE Dirham (2.5 crores INR). 

The 2nd establishment of the petitioner was worth 2.5 million UAE Dirham in the year 1985 and the average earnings per year was more than 45 lakhs INR.

The 3rd establishment of the petitioner was worth more than 10 million UAE Dirham (10 crores INR) and average annual earning was more than 2 Million UAE Dirham (2 crores INR).

The asset detail of the 3rd establishment issued by the registered chartered accountant of the 2nd establishment dated 18.8.1984 is produced herewith and marked as Exhibit P4.

Apart from the above said assets the petitioner is also having bank accounts with National Bank of Abu Dhabi, the British Bank of Middle East and an amount of 8 lakhs UAE Dirham (80 lakhs INR approx.) was lying with the bank along with cash and cheques in the office shelf.

Thus, altogether as on 1995 the assets (Other than  Work Contracts, Human Resources and Reputation) of the petitioner was worth more than 30 million UAE Dirham (35 crores INR approx.) with an annual earning of 4.95 million UAE Dirham (4.95 crores approx.).
